Abstract

This contribution to the discussion of the book Law as a conversation between equals by Roberto Gargarella has two objectives. Firstly, the coincident ideas that allow us to think about social rights in our contemporary democracies characterized by pluralism and profound disagreements are clarified. Secondly, three problems of the conception of democracy that the author defends are raised and discussed in relation to the protection of social rights “in charge” of citizen dialogue: the basic notion of equality, the lack of protection of preconditions of the procedure and excessive trust in citizens to respect social rights.
