The failure of governments to respond to the problems arising from global warming led to the emergence of so-called climate litigation at the beginning of the century. Although most of them did not prosper, they have increased considerably in recent years. This paper analyses the evolution of these lawsuits and how a more loose interpretation of the political question doctrine by the courts has facilitated this growth. It also addresses the relevance of climate litigation in developing climate change mitigation and adaptation strategies. The study will show that the courts have been effective only in demanding government mitigation measures. Finally, it analyses some of the reasons hindering the use of the courts to demand the adoption of measures capable of dealing with the impacts of climate change.
